Petition, for a declaratory judgment under RSA 491:22 by Robwood Advertising Associates, Inc. to the Superior Court from an
administrative ruling of the city of Nashua zoning board of adjustment. The board on February 14, 1959, ruled that the plaintiff
was not entitled to a hearing before the board because it had not complied with the consent requirements of Article IX --
s. 45-A (5) of the 1957 Nashua zoning ordinance. The board based its ruling wholly upon its alleged lack of authority to hear
the case in the absence of compliance by the plaintiff with the consent provision. Subsequently, pursuant to RSA 31:74, 75 , the plaintiff again appealed to the board and was again denied upon the same grounds.
